REGULATIONS FOR BOOKING HOTEL ROOMS, OTHER HOTEL SERVICES, AND GUEST STAYS AT PARK INN RESORT FACILITIES

INTRODUCTION

1. These regulations define the terms and conditions for the provision of Services by the Service Provider, the rights and obligations of the Service Provider and Service Recipients related to the provision of accommodation Services and additional services, the principles for the protection of personal data of natural persons using them, and the principles for excluding the Service Provider's liability for the provision of Services.

2. The Regulations have been posted by the Service Provider on the Service Provider's website in a manner that enables the access, reproduction, and recording of the Regulations' content using the IT system used by the Service Recipient.

I. General Provisions
1. The terms used in these Terms and Conditions shall have the following meaning:
a. IT System - a set of interoperable IT devices and software, ensuring the processing and storage, as well as the sending and receiving of data via telecommunications networks using a terminal device appropriate for a given type of network, within the meaning of Telecommunications Law,
b. Distance Contract - a contract concluded with a consumer as part of an organized system of concluding distance contracts, without the simultaneous physical presence of the parties, with the exclusive use of one or more means of distance communication up to and including the moment of conclusion of the contract,
c. Electronic Communication Means - technical solutions, including IT devices and software tools interoperating with them, enabling individual distance communication using data transmission between IT systems, in particular e-mail,
d. Service Provider - conducting business under the name: Park Inn Resort, UL. Łowicz Walecki 62, 78650 Mirosławiec, West Pomeranian Voivodeship; NIP: PL7651462461, REGON: 570343750, operator of PARK INN RESORT in Łowicz, Wałecki 62, 78-650 Mirosławiec, Poland.
e. Service User – an entity being a natural person, legal person, or organizational unit without legal personality, using the services of the Service Provider. The Service User may also be a Guest.
f. Guest – a person using accommodation or additional services offered by PARK INN RESORT. This person may also be the Service Recipient.
g. Registration Form - an online form posted on the Service Provider's website, used to register the Service Recipient in the system.
h. Online Reservation - a reservation of hotel services made in the system in real time using the Internet Booking Engine located at http://www.parkinnresort.pl/.
i. Authorization Document - a document specifying the detailed terms and conditions of the reservation, including: the length of stay, the amount due for the stay, and the deadline for payment of the deposit for the stay at PARK INN RESORT.
2. Before using the services provided by the Service Provider, including via the website and the reservation engine, the Service Recipient is required to read these Terms and Conditions and confirm their acceptance of their terms.

II. Method of Making a Reservation
1. To make an online reservation, via the IT system used by the Service Provider, it is necessary to use commonly used web browsers.

2. Proper use of the services provided by the Service Provider via the ICT Service is possible after the Service User's web browser is set to accept cookies and the pop-up blocker is disabled.
3. The Service Provider provides services to the Service User within the scope and under the terms specified in these Terms and Conditions.
4. The Service User agrees to comply with these Terms and Conditions.
5. The Service Provider reserves the right to conduct maintenance of the ICT system, which may cause temporary disruptions or prevent Service Users from using the ICT Service. 6. Reservations can be made via:
a. the property's website and the booking engine (Internet Booking Engine) located on the Service Provider's website,
b. completing and signing the reservation form on the property's website and sending it to the property electronically,
c. placing an order for a stay at the property in writing, by fax, or electronically (e-mail),
d. making a reservation by telephone,
e. in person, in writing, at the property's reception desk, so-called direct "off-the-street" booking.

III. Reservation Process
1. Online reservations are made by following the instructions provided by the automated booking system, completing the registration form, and making the required payment.
2. The Service Recipient is fully responsible for any consequences resulting from providing incorrect data in the forms.
3. Prices displayed in the system are per room.

Prices are for 1 hotel night or 1 guest night and include VAT. They may also include other services specified in the offer description. If the offer includes breakfast or other additional services, this information is provided in the price description displayed in the system during the booking process. For services not included in the order (e.g., additional catering or spa services), payment must be made on-site by the Guest.
4. The payment unit is the Polish zloty (PLN).
5. In the case of payment by bank transfer, all fees are the responsibility of the Service User.
6. After making a reservation as specified in Part II, paragraph 6, letters b-d above, the property will send an Authorization Document to the mailing address, email address, or fax number provided by the Service User, specifying the validity of the offer and the required deposit amount for the booked stay.

IV. Price for Accommodation Services and Additional Services

The price list for accommodation services/rooms/stay packages at the property is available on its website at http://www.parkinnresort.pl, containing prices current on the date of booking and in the booking engine, also available on the property's website. Prices available on the property's website are per room for one hotel night with breakfast (booking engine) or per stay package (prices and packages), which includes breakfast, dinner, with or without additional services. Prices may also include other services specified in the offer description. If a given offer includes breakfast or other additional services, this information is provided in the price description displayed in the system during the booking process or in the Authorization Document sent to the Service User.
The price list for food and beverage services is available at the Tawerna Fish & Grill Restaurant.

V. Payment and Invoicing
a. Payments are processed directly during the online booking process. If payment is required for confirmation, the Service Recipient will be informed accordingly. A reservation is deemed completed only after a prepayment (deposit) has been made in the amount specified by the property. The prepayment amount is specified in the terms and conditions of the price offer.
b. The Service Recipient reserving a hotel room may pay the deposit amount referred to above by bank transfer, e-transfer, cash, or by debiting a payment card with the Service Recipient's written consent.
c. The deposit must be paid within the time specified in the Authorization Document.
d. Payment card authorization and payment settlement are handled by a third party via a direct connection to the payment card processor's server.

e. The date of payment is deemed to be the date on which the PARK INN RESORT bank account is credited -

Bank PKO Bank Polski S.A., IBAN account number: PL70 1020 2847 0000 1702 0008 5761, SWIFT CODE: BPKOPLPW,

and for card payments, the date of positive authorization is considered.

f. The Service Provider issues VAT invoices in accordance with applicable Polish tax law.
g. In the case of in-person hotel room rentals directly at the Reception Desk (so-called direct bookings from the street), the Reception reserves the right to pre-authorize the payment card at check-in or to directly charge the payment card if payment for the stay is to be made by payment card. In the case of cash payment, the amount for the stay is paid in advance. In such a situation, a "deposit" is not applicable. h. The facility's billing period is seven days, which means that each Service User booking a stay longer than 7 days is obligated to settle the amount due for the stay and services used within 7 days of the commencement of the stay. In justified cases, the Service Provider reserves the right to request an increase in the credit security amount on the Service User's credit card or to settle the amount due for the stay at the facility at an earlier date.

i. The Service User may use additional services at the resort under the so-called "Hotel Credit," which allows for credit orders ("room bill") for services accompanying the guest's stay, only after providing the facility's Reception with the guest's payment card number and its expiration date, along with the guest's consent to charge or pre-authorize it. A "Hotel Credit" may also be opened if a cash deposit is submitted at the facility's reception – up to the amount of the deposit. The value of ordered hotel services is calculated in accordance with the Hotel Price List and/or Special Offers in effect on the date of the order.

j. Accepted payment cards: Visa, Visa Electron, MasterCard, Maestro, MasterCard Electronic.

VI. Reservation Confirmation
a. A reservation is considered made when a confirmation number is issued by the online reservation system.

The reservation is deemed made upon the Guest's receipt of a written confirmation of the reservation from the property's reception desk, subject to the provisions of Section VI. b-d below.
b. The reservation is deemed made upon the Service Recipient's payment of the advance payment for the stay at the property, in accordance with the declared duration of stay. Advance payment for the stay can be made in cash, by bank transfer, or by debiting funds from a payment card with the Guest's consent.
c. Additionally, the online reservation system automatically generates an email confirmation sent to the Service Recipient's address provided in the form.
d. Failure to pay the advance payment by the deadline specified in the Authorization Document will be deemed the Service Recipient's withdrawal from the hotel reservation and will result in the assumption that no effective agreement for the provision of hotel services has been concluded between the parties.

VII. Conditions for Changes and Cancellations of Reservations.
Exceptionally, with the written consent of the Service Provider, a reservation may be changed or canceled, but only for valid reasons, justified and documented by the Guest in writing, in accordance with the terms set out below.

Cancellation Policy:

In the event of cancellation of a booked stay, the Guest will be charged a cancellation fee of:

0% of the booked stay value for cancellations made 60 days or more before the planned arrival
0% of the booked stay value for cancellations made between the 59th and 30th day before the planned arrival
0% of the booked stay value for cancellations made between the 29th and 15th day before the planned arrival
100% of the booked stay value for cancellations made less than 24 hours before the planned arrival or for no-shows without canceling the reservation.

The difference between the payment made for the reservation and the cancellation fee (if any) will be refunded to the Service User via bank transfer to the bank account specified by the Service User.

The cancellation fee will be deducted from the deposit or the paid stay amount, or charged to the payment card. A separate invoice will be issued for the remaining cancellation fee (if applicable) and sent to the Guest's mailing address.

Cancellation requests must be submitted in writing, by fax, or email.

With respect to reservations for periods of special interest, the property reserves the right to introduce different cancellation terms in the Authorization Document, or even completely exclude the possibility of submitting a cancellation request.

VIII. Conditions for Concluding and Terminating Contracts.
1. The conditions for concluding and terminating contracts for the provision of hotel services by the Service Provider are exhaustively specified in these Terms and Conditions. Except in these cases, termination of the contract is only possible by mutual agreement of the parties, made in writing under pain of nullity.
2. The Service Recipient does not have the right to withdraw from the hotel service reservation contract, in accordance with Art. Article 38, point 12 of the Act of 30 May 2014 on Consumer Rights (Journal of Laws of 2014, item 827) ("Consumer Rights Act").

IX. Personal Data Protection
1. Data is collected via the website www.parkinnresort.pl by completing forms. The form contains required fields, which must be completed, and additional fields that can be completed by the Service User. The data provided in the form is processed for the purpose resulting from the function of the specific form.
2. The data is stored and processed by the Service Provider under the terms specified in the Personal Data Protection Act and the Act on the Provision of Electronic Services.
3. The Service User has the right to access, correct, amend, and delete their data.
4. The provision of personal data by the Service User is entirely voluntary, however, refusal to provide it in certain cases may prevent the conclusion of the contract.
5. The Service Provider informs that pursuant to Art. 18 of the Personal Data Protection Act, the Service Provider has the right to process the Service User's personal data in accordance with and to the extent specified in the aforementioned Act for purposes related to the processing of online reservations at the resort's facilities. The Service Provider will receive this information through registration or logging into the system.
6. The personal data controller is: Park Inn Resort, Łowicz Wałecki 62, 78-650 Mirosławiec, West Pomeranian Voivodeship; Tax Identification Number (NIP): PL7651462461
The Service User has the right to access and correct their personal data.

X. Complaint Procedure
1. Complaints may be filed for:
a. Failure to meet the contractual commencement date for the Service Provider, due to the Service Provider's fault;
b. Failure to perform, improperly perform, or incorrectly bill the Service.
2. Complaints may be filed within 14 days from the date on which the Service was performed or The complaint must be processed.

3. A complaint should:
a. be submitted to the Service Provider's registered office address or by email to info@parkinnresort.pl,
b. include the reason for the complaint and specify the scope of the Service Recipient's request,
c. be signed and contain the Service Recipient's current details.

XI. Transitional and Final Provisions
1. In matters not covered by these Terms and Conditions, the provisions of the Civil Code (Journal of Laws of 1964, No. 16, item 93, as amended), the Act on the Provision of Electronic Services (Journal of Laws of 2002, No. 144, item 1204, as amended), and other generally applicable provisions of law shall apply.
2. The Service Provider reserves the right to amend these Terms and Conditions, provided that the version of the Terms and Conditions in effect at the time the Guest places the order shall apply to reservations made before the amendment to the Terms and Conditions. 3. Date of publication of the regulations: March 17, 2022

XII. Additional information
Check-in begins at 2:00 PM. Check-out ends at 10:00 AM.

PERSONAL DATA PROCESSING

Personal data will be processed for the purpose of completing the reservation process, investigating any violations of the Regulations or applicable law, and handling any complaints.

In accordance with Article 13, paragraphs 1 and 2 of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (GDPR), we hereby inform you that:

The controller of personal data obtained during the reservation process, within the meaning of applicable generally applicable law, is Park Inn Resort, ul. Łowicz Wałecki 62, 78-650 Mirosławiec.

The entity processing personal data is the online reservation system Hotres.pl, owned by HOTRES Sp. z o.o. with its registered office in Jelenia Góra, 58-570 Młyńska Street 12A, hereinafter referred to as Hotres.pl.

Personal Data

For the purposes of the reservation process/issuance of a sales document, the Guest's personal data is collected. Providing personal data is voluntary, but necessary to complete the reservation process.

The Guest has the right to access, rectify, and delete their personal data, as well as the right to limit its processing.

The Guest's optional consent to the processing of data for marketing purposes requires checking the appropriate checkbox during the reservation process.

This consent may be withdrawn by sending an appropriate message to the following email address: info@parkinnresor.pl.

The detailed purposes and scope of personal data processing in the Hotres system are specified in the appendix.

Administrator's Obligations

The Administrator guarantees that Guest's personal data is not shared with third parties and will take the necessary measures and utilize its knowledge and experience to ensure this.
The Administrator reserves the right to disclose personal data to authorized entities and in cases provided for by generally applicable law. This applies in particular to entities such as online payment systems and reception software.
The Administrator is obligated to maintain the confidentiality and confidentiality of information obtained for the purpose of completing the reservation process. This obligation remains in effect for an indefinite period.

Hotres.pl Obligations

Hotres.pl, as the entity processing Guest's personal data, ensures the implementation of appropriate technical and organizational measures, as well as additional IT security measures, based on proven servers and systems for processing personal data in services provided electronically. Hotres.pl declares that the IT systems used to process personal data meet the requirements of applicable law, in particular that they are protected to a high degree within the meaning of the Regulation of the Minister of Internal Affairs and Administration of April 29, 2004, on personal data processing documentation and technical and organizational conditions that should be met by devices and information systems used for personal data processing.

Subcontractors and employees of Hotres.pl will be duly authorized to process personal data in connection with the reservation process, to which the Administrator and Guest consent.

To ensure the highest security in storing personal data in accordance with GDPR requirements, Hotres.pl is committed to:

encrypting and animating the transmission of personal data

continuously ensuring the confidentiality, integrity, availability, and resilience of processing systems and services

the ability to quickly restore the availability and access to personal data in the event of a physical or technical incident

regularly testing, measuring, and assessing the effectiveness of technical and organizational measures to ensure the security of processing ments.

Final Provisions

The Administrator is entitled to amend the provisions of these Terms and Conditions at any time and at its sole discretion. In particular, it may amend the provisions of these Terms and Conditions in the event of:

the need to adapt the Terms and Conditions to mandatory provisions or changes in legal provisions affecting the content of these Terms and Conditions;

the need to adapt the Terms and Conditions to a recommendation, interpretation, ruling, resolution, or decision of a public authority or court ruling affecting the content of these Terms and Conditions;

the expansion or change of Hotres.pl's functionality;
